Our terms and conditions comply with German legislation and are designed to ensure that customers can shop with confidence with emioli.de.
- Pricing
All prices are in Euro and include VAT until the checkout. Packaging and delivery charges are not included . Any exceptions will be clearly marked on the website where relevant. Prices may be subject to change without notice, but we will only alter the price after we have confirmed your order, if is to your benefit.
- Payment
Customers may transfer the money to our bank account or use the Paypal service. If customers choose to use bank transfer service, we give an additional of 5% discount of the total payment. However, bank transfer should be carried out in Euro ONLY. If other currency is used for the transaction, additional charges will be imposed.
- Orders and Security
When customers place an order, either online, by telephone, or in writing, it will be treated as an offer to buy. We will accept the order by sending a confirmation e-mail with an order number, at which point we make a legal contract with customers. However, we may refuse to accept the order if we feel it necessary, in which case we will notify the customers as soon as we can. When the customers receive the e-mail confirmation, they will have an opportunity to check the details and correct any errors. In deciding whether to accept any order we may use the information customers have given us, or we already hold about them, or which we receive from any enquiry we may make with various agencies, to confirm customers identity. This assists us to protect customers and us from fraudulent transactions. If we decline customers offer on security reasons we may seek an alternative payment method.
- Delivery
Except where specifically stated, prices are not inclusive of delivery. Our deliveries in the Germany are contracted to outside carriers who deliver Mondays to Fridays (such as DHL, GLS or Hermes). We will inform customers by e-mail or telephone at least 48 hours prior to despatch of our expected delivery date. We regret that we are unable to specify exact delivery times within that date. All deliveries must be signed for and customers should keep their receipt. If goods are showing obvious signs of damage in transit upon receipt, please refuse to accept the delivery.
Embroidery design files will be send via e-mail or may be downloaded in our website. For this service, no charge applies. Customer is responsible for keeping the files safe after receiving them via e-mail or download them from our server. In the case of data lost (caused by software, hardware or any other failure), EmiOli Design is not liable for providing those lost files anymore.
- Cancellation
We are pleased to offer a hassle-free cancellation policy, which is in addition to customers statutory rights. Should the purchase disappoint in any way, customers may normally cancel the purchase provided a notification before or within 14 days of delivery. The product muss be complete, unused and in "as new" condition (e.g. if you have opened the packaging to examine the product, you must have done so without damaging or marking the product in any way). It should be returned with the original box, packing and accessories. Should the purchase costs more than 40€, we will reimburse the delivery cost. Otherwise, customers will be responsible for the costs.
Please note that orders, which have been delivered per e-mail or direct download, cannot be cancelled and refunded.
- Transit Damage
All goods are examined in detail by ourselves prior to despatch to ensure that they leave our warehouse in perfect condition. However, transit damage unfortunately can occur. If the purchase is showing obvious signs of transit damage upon delivery, please refuse to accept delivery and notify us immediately. If damage is only evident upon opening of packaging, then customers must inform us within 48 hours of receipt. In either case, we will then arrange re-delivery of replacement goods as soon as possible.
- Legal
Sales on this website are governed by German law and customers agree to submit any dispute to the non-exclusive jurisdiction of the German courts. All orders are subject to these terms and conditions and no amendments will be accepted by us. These terms and conditions do not affect customers legal rights. These terms and conditions only cover the EmiOli Design website. Any other web sites to which customers link from this site may be governed by their own terms and conditions. We accept no responsibility or liability for the content of web sites which are not under our control. We do not guarantee that this web site will be compatible with all customers computers.
